Last month on the 9th & 10th, BBGV welcomed our colleague chambers from Cambodia, Indonesia, Malaysia, Philippines, Singapore and Thailand to attend the bi-annual BiSEA (Britian in South East Asia) conference in HCMC. The two-day conference was highly informative where participating chambers gave updates on their country's economic and trade situations and shared best practices of "How to be a Better Business Group'. Our guests enjoyed their time in HCMC and had a chance to visit the city and meet with BBGV members during the Celebration of the Queen's 85th Birthday on the evening of the 9th. Upcoming Charity events: BBGV's Fun Run for Charity, which is scheduled on Sunday 2nd October, will be postponed. Unfortunately, due to matters out of our control we have to postpone the Fun Run until later in the year, more information to follow.

Submitted by Standard Chartered Bank (Vietnam) LtdSince February, the government and the State Bank of Vietnam have implemented a number of policies to maintain price and exchange rate stability, including higher interest rates and a more stringent loan growth target at 20% for 2011. While headline inflation, on a year-on-year basis, is likely to rise further between now and Q3, the FX market has reacted favourably to the government policies. The commercial USD-VND exchange rate has been trading at the mid-section of the permitted trading band in recent weeks, instead of the ceiling. The IMF reported that the country has added around USD 0.9bn to its foreign exchange reserve in the first five months of the year.

Submitted by PWCThe ability to claim a foreign tax credit ("FTC") is permitted under current Vietnam regulations, subject to supporting documents being available. In practice, the Vietnam tax authorities have imposed stringent and difficult documentation requirements meaning that claiming a FTC has proven difficult. To help our clients manage the FTC claim, PwC wrote to the General Department of Taxation ("GDT") to find a solution and received a response by way of Official Letter 2013/TCT-TNCN dated 14 June 2011.

In his Budget speech in March, the chancellor of the exchequer, George Osborne announced that he would see to introduce a Statutory Residence Test ("SRT"), and would also reform some of the non-domicile taxation rules, for 6 April 2012. Both will have a major impact for employers with UK inbound and outbound populations as well as the employees themselves.

Vietnam is no exception – we can easily find this term in everyday business life, in legal and commercial documents, in public media, etc. So, let's examine closely what is a transfer of business. Decree 108 implementing the Law on Investment provides that, amongst other forms of green-field investment (e.g. new investment in new company set up), investors are allowed to make investment in other forms such as capital contribution, purchase stocks, consolidate, and acquire business.
